Description: I believe this Anne Byars and William Smith are my 4th great grandparents, William and Ann. I have a mix of cemetery and bible info for their children; Mary Jane Sue Smith Weddington, James J. Smith (headstone says son of William and Ann Smith), and Charles Smith buried at Akers Chapel in Hull IL. My great grandmother wrote in a bible the year her grandmother, Mary Jane Sue Smith Weddington passed..as well as the birth in death year of her great grandmother, Ann Smith. It also has Willam Smith as Ann's husband. . I have no early records for Ann and her siblings, but I was able to connect them to an online tree with matching birth dates matching the headstones. The tree listed on family search had no sources, but does seem to match what you have...with an additional generation.

William Byars bought Brooke Hall from his cousin James M. Dysart in 1806. He later built a second Brooke Hall across the road. He was one of 14 children of John Byars who died in 1781 in Louisa County, Virginia. John's wife was Elizabeth Thomas. John's parents were Henry Byars and Peggy Gentry. James Dysart was married to Agnes Nancy Beattie whose Brother David was Elizabeth Beattie's Father. The Byars were already related to the Dysart's and Beattie's in Ireland and Scotland. James Dysart and David Beattie fought in the Battle of King's Mountain in the revolution.

William made his money operating a grist mill and a distillery. The profits were used to expand his land holdings and to purchase slaves (he owned 47 by 1830). In the late 1820s he built an immense estate which he also called Brook Hall. The 8,800 square foot home consisted of 26 rooms, including a ballroom. There were several unique features including a suite of rooms built for the colonel's daughters that could only be accessed through a hidden stairway. The house sat 3 stories tall and included a basement.

Eliza continued to live with her daughter and son-in-law, but tragedy struck the community of Holly Springs in the summer and fall of 1878 when a yellow fever epidemic swept through the Mississippi Valley. Within a 16 day period Elizabeth died, along with two of her children. Eliza remained with her son-in-law, no doubt helping raise Elizabeth's 4 surviving children.

By 1860 John and Jane appear to have moved to their new home, known as Cave Springs, where they would live for the next 30+ years. The home sat on land owned by John's father, Col. William Byars. The brick structure contained 14 beautiful, high-ceilinged rooms, eight of which had their own fireplaces. There were many additional out-buildings, including slave quarters. A long road led up to the house; John was known to drive it in a carriage lined in velvet and drawn by a team of white horses. Years later, the home was remembered as a showcase. It sat just west of Brook Hall, where the widowed Col. Byars resided.

The 1860 census enumerated John and Jane as Col. Byar's neighbors. John was not listed as the owner of the property on which he was living, but he was listed as the owner of personal property worth over $10,000, which included 13 slaves. However Col. Byars real estate holdings were valued at almost $85,000 and his personal property was listed at $41,500. These were both very large amounts for the time and neighborhood.

The 1860 agricultural schedule provides additional information about Cave Springs. The farm consisted of 150 acres of improved land and 90 acres unimproved; it was valued at $10,000. The livestock, valued at $5,625, consisted of 5 horses, 10 mules, 13 cows, 6 oxen, 110 other cattle, 20 sheep and 75 swine. In the previous year the land produced (among other things) 150 bushels of wheat, 80 bushels of rye, 2,000 bushels of Indian corn, 1,000 bushels of oats, 24 pounds of wool, 500 pounds of butter, 20 tons of hay and 30 gallons of molasses.

The makeup of John and Jane's family had changed in the years between the 1850 and 1860 census enumerations. Daughter Sarah died in 1856 at age 9 and daughter Elizabeth married John Hall. In 1860 the young couple were also enumerated living at Cave Springs.

Col. William Byars bequeathed John a portion of Brook Hall Farm [Cave Springs] when he wrote his will in May 1858.

The 1870 census enumeration included John and Jane, along with Elizabeth and John Hall, and 9 year old William Hall. Oddly, John Hall and not John Byars was listed as the head of the household and the property owner (owns real estate valued at $17,300 and personal property valued at $2,000).

In 1880, John Byars was enumerated as the head of the household which was no doubt a more accurate representation. John was 69; his occupation was listed as "farmer". Jane was 60. John and Elizabeth Hall and their 17 year old son William were again part of the household. A servant was also present, as was 50 year old Ann Eliza Nye.

John married Jane Beattie Ryburn on 24 Oct 1836 in Washington County, Virginia. Following their marriage the young couple lived with Amanda's father at Brook Hall. It was a spacious home with plenty of room for Amanda and John's growing family. Family tradition holds that Col. Byars promised Brook Hall to Amanda at the time of her marriage to John.

William Byars died in February, 1866. His will formally left Brook Hall and much of the surrounding land to Amanda, as well as 10 slaves, farm animals and various other household items. He also left her an 8 day clock "now at the college" [no doubt Emory and Henry]. William also provided for Amanda's children.

Two years later, in March 1868 John was crushed to death by a falling log on the Brook Hall property. His death left Amanda a 45 year old widow with five children and a large farm to run.

Amanda remained at Brook Hall and ran it with the assistance of several hired laborers. In 1870 she was enumerated with all 5 of her children. The farm was valued that year at $34,000. Her eldest two children married in the late 1870s. In 1880 the household included Amanda (54), son James (24), daughter Betty (20) and daughter Lucy (16).

James's father died in 1866. His will, written in 1858, left James all the slaves in his possession [which by 1866 would have been none]. James also received a share of his father's lands not otherwise devised and was named as his father's executor.

John and Jane Byars lived in a beautiful home called Cave Springs, built for them by John's father, Col. William Byars

Besides Ann Eliza, John and Jane's 1880 household included their daughter Elizabeth (Byars) Hall and her husband John Dayton Hall. Elizabeth Hall and Ann Eliza Nye were fairly close in age. Elizabeth Hall named her only son after her grandfather, Col. Byars. Ann Eliza Nye also named her only son after the colonel (he was her great uncle). Years later William Byars Nye named a son John Dayton Nye.

Elizabeth Hall remembered both William Byars Nye and John Dayton Nye in her will. Elizabeth left Cave Springs to Ann Eliza's nephew Arthur M. Byars, suggesting the Byars, Hall and Nye families remained close.

Cens-1850 14 Aug 1850 He was about 7 years old when his father died leaving a widow with at least 8 children still at home.4
Cens-1860 28 Jul 1860 By 1860 Samuel lived with Adeline and Jacob Wolfe [Adaline "Batie" Byars married Jacob Wolfe in 1847 in Smyth County; Adaline was probably Samuel's sister]. Jacob Wolfe was a brickmason.5
Military 18 Apr 1861 Samuel enlisted in Co. B. (later Co. D) of the 4th Virginia Infantry (the "Smyth Blues") on April 18th, 1861 at Marion, Virginia. He stated he was a brickman by occupation. Samuel was taken prisoner during the first Battle of Kernstown on March 23, 1862. This was the opening battle in Stonewall Jackson's campaign through the Shenandoah Valley. However by March 1863 he was again listed on the muster rolls for Company D. On May 3rd 1863, during a charge on the breastworks at Chancellorsville, he was shot through the left ankle. Samuel was sent to the Confederate hospital at Richmond. By November he had recuperated enough to return home on furlough. Later muster rolls suggest he was not able to return to the company. The damage to the joint eventually caused it to ankylose.6,7
Marriage circa 1866 He married Eleanor V. Patterson, daughter of Thomas E. Patterson and Mary (?), circa 1866.8
Cens-1870 28 Sep 1870 Samuel and Eleanor were recorded in the late summer of 1870 with two children: Robert (3) and John (3 months).9
Widowed 19 Apr 1874 Eleanor died of fever four years later, in April 1874.
Marriage 18 Aug 1874 He married second Almeda America Cole, daughter of Sampson Cole and Eliza Cole, on 18 Aug 1874 in Smyth County, Virginia.10
Cens-1880 8 Jun 1880 In 1880 Samuel was recorded farming in the Holston District of Washington County. The members of his household were enumerated to include Samuel, his two sons from his first marriage, Almeda, and S.A. Nickles who was indicated as a servant.11
However 6 days later Almeda was recorded a second time; this time in her father's household in Smyth County with a 4 year old listed as Bird Byars. Bird was identified as Sampson Cole's grandson which suggests he was probably Almeda and Samuel's child. Almeda's marital status was noted as "divorced."12
In reality Samuel and Almeda's divorce was probably not finalized until early 1892.13
Marriage 28 Mar 1892 He married third Sarah A. (Thomas) Nichols on 28 Mar 1892 in Washington County, Virginia.3
Sarah was the same person as the S.A. Nickles who was enumerated in Samuel's 1880 household.11
Cens-1900 15 Jun 1900 The 1900 census provided further information about Samuel's farm. It was located in the Holston District of Washington County and was not mortgaged. Samual and Sarah's household included 7 year old "Livie" Stoval, who was identified as Samuel's granddaughter.14
"Livie", whose name was Libbie, was actually Sarah's granddaughter; the daughter of Mary Tina (Nichols) Stovall.15
The cemetery in which Samuel and two of his wives are buried probably sits on the land Samuel owned in 1900. It is situated off Friendship Rd., northeast of the community of Friendship in the southeast corner of Washington County. Interestingly, the land is near Patterson Creek; perhaps named for Samuel's first wife's family.
Cens-1920 3 Jan 1920 However by 1920 Samuel and Sarah lived in neighboring Smyth County. That years census, enumerated in early January, recorded their residence as "Rail Road Front" in Chilhowie.16

Elizabeth's grandfather, Col. William Byars, added a codicil to his will the month after Elizabeth gave birth to her only child, William. In it he bequeathed Elizabeth a tract of land on Cedar Creek in Smyth County, Virginia.

John (Hall) and Elizabeth, and their son William made their home in Glade Spring Township with Elizabeth's parents, John and Jane (Ryburn) Byars.

They all resided in a large brick home known as Cave Springs which had been built for John and Jane Byars on the lands of Brook Hall Farm, the plantation belonging to John's father, Col. William Byars.

The 1870 census listed John Hall as the head of the household with real estate holdings of over $17,000. Although he may have owned real estate at this time, it is unlikely he should have been recorded as the head of the household since Elizabeth's father was still living.

By 1900, John was deceased, as were Elizabeth's parents. She was enumerated that year with her 38 year old son, William, who died a few months later. Several other relatives were also listed in the household, including Elizabeth's cousins, Vene Ryan and Bertha Carmack, and a nephew, Mack Byars.

The month before her death Elizabeth wrote a lengthy and very detailed will. She requested that a tombstone be placed at her grave like the one at the grave of her beloved husband. She also requested the same for her son William and her mother and left money to maintain the graves. Elizabeth left 300 acres of the "home place", including the residence [Cave Springs], to her cousin A.M. Byars. She instructed her other lands be sold and bequeathed cash gifts to many people, including "her cousins" Mrs. M.L. Ryan, Mrs. Bettie Susong, Byars Clark, Mary Jane Clark, A. Lavinia Hutton and Addie Hutton. Elizabeth also left cash or specific gifts to a wide variety of individuals and institutions. She particularily remembered Bertha Carmack and wrote, "she (Bertha) has been very kind to me in my sorrow and loneliness.

Three days after her death, Elizabeth's will was recorded in Washington County court. A.M. Byars and F.B. Hutton took the oath of executors and with the United States Fidelity Company as their security, posted bond in the amount of $10,000. Elizabeth's will had stipulated that they not be required to post bond in excess of that amount.

J. Cloyd, in the same paper mentioned earlier, stated: for many years Mr. Byars was one of the leading farmers in Southwest Virginia. As an importer of thoroughbred livestock, he became a public benefactor. But what was a public benefit was a private catastrophe. He saw his magnificent estate, and beautiful home pass out of his hands in his old age.

I am sharing a report generated after we talked.

My wife's maiden is masked to "R."

For searching this, know that the living male Byars descendant in this line is William Lemuel Byars, II. He was born before 1940 so he should be searchable as William L. Byars, son of William L. Byars I, son of the James G. Byars in the shared chart. He has autosomal and STR testing done with Family Tree DNA. Having a basis, I will let him know and should we decide to do so, he will agree to SNP testing.

Know that he, a 1st cousin of my wife's and a nephew of my wife by her sister have confirming matches to Byars of the South. But, I agree, the Nathan Byars of the Cowpens relationship merits careful review. My conclusion when I looked at it was there was a possibility of an independent immigration of Byars to the Carolina area even though I found the same evidence as you that James Henry was in Granville County, actually moving back and forth from Louisa County, VA to Granville County. Another solid genealogical trace was the trace of a COL William Wallace to the Abingdon, VA area where he founded a college whose name now slips from me.

I go with you. I have found and identified male Y-DNA running Family Finder matches back through three female lines and working (and finding) Y-DNA matches of descendants of differing sons of a person born about 1700. That particular ancestral material line is now confirmed by proper matches by SNPs to sons of ancestral Wallaces leaving this Wallace farm in the 1820.

I administer the Wallace DNA Project of some 700 with some 400+ males of 25+ haplogroups and about 400 autosomal test results. Most find some matches in that project. I am an I2c PF6328 > IF2044. There is a huge line I2c PF6328 > BY19 (BY445) who immigrated to the North in the early 1700s but are scattered in the South from the Carolinas heading west through Tennessee dating to the late 1800s.

But, I am with you. No matter the quality of DNA matches, it means little without good genealogy. Equally, I seldom do genealogical reviews anymore without corresponding DNA matches.

He was born on December 2, 1934 in Dallas, TX to Hilary Herbert Cunningham and Bettie Byars (Stallcup) Cunningham.

He married Maylee Faulk on December 27, 1958 in Dallas, TX.

He attended University of Texas and received a B.S. degree in Aeronautical Engineering. He also received an M.S. degree in Civil Engineering from Southern Methodist University.

He worked for American Airlines in Tulsa, OK for 31 years. He was a Mason for almost 50 years. He was actively involved with Boy Scouts of America (BSA) for over 25 years.

He was preceded in death by his son, Mike Cunningham.

He is survived by his wife, Maylee Cunningham of Owasso, OK; son, Kevin Cunningham and wife, Tari of Tulsa, OK; son, Scott Cunningham and wife, Brenda of Las Vegas, NV; son, Mark Cunningham
of Tulsa, OK; grandchildren, Cassidy Cunningham and Cori Beth Cunningham, whom he loved dearly.
