    • Laban's Will, dated September 16, 1868, left Daniel the "seventy acres of land where he now lives." Daniel and his brother Jeptha were appointed executors on their father's estate. Following Laban's death there was a lawsuit among his heirs in Smith County, Tennessee, styled Jeptha Driver, et als vs. Wm. & Rebecca Driver, et als, mainly concerning whether or not Laban had given his son Jeptha all of his stock and farming equipment prior to his death in exchange for Jeptha caring for him in his old age. On Sep 26, 1870, Jeptha and Daniel Driver signed a note promising to pay A.A. Swope $25 for acting as their attorney in with respect to the will of their father Laban Driver; Daniel's signature appears thusly: On Jan 28 1878, Jeptha Driver testified in court thusly, when asked whether any of his siblings had enjoyed the use of any of their father's land: I don't know how long Daniel Driver lived on the part he used. He never paid any rent. He went there in the woods and cleared up the land. I suppose he was there some 12 or 15 years before my father died [in 1868, which would have made Daniel around 20-22 when he moved to the land]. I was small when he went there. I suppose he had 20 or 25 acres cleared before the old man's death, there was only a small patch cleared there when he went there. When the old man gave me up my part of the land about two years before his death, he gave Dave his part also and he has to pay part of the taxes, and he done it. [2]
